New TSA Freight Rail Security Regulations Effective April 1, 2009

As announced last November, the Rail Transportation Security final rule created by the Transportation Security Administration goes into effect on April 1st.

This ruling affects all Rail Security Sensitive Materials, which includes TIH/PIH, more than 5,000 lbs of a division 1.1, 1.2, or 1.3 Explosive material and Class 7 radioactive materials for both shippers and receivers.

The regulation establishes security requirements for freight railroad carriers and rail operations at certain, fixed-site facilities that ship or receive specified hazardous materials by rail. This rule codifies the scope of TSA's inspection program and also requires that regulated parties designate rail security coordinators and report significant security concerns.

Freight rail carriers and certain facilities handling specified hazardous materials must be able to (1) report location and shipping information to TSA upon request and (2) implement chain of custody requirements to ensure a positive and secure exchange of specified hazardous materials.

If you ship TIH/PIH material, your rail carrier should have notified you of new requirements for meeting these regulations. Non-compliance may result in freight delays and assessment of assessorial charges.
